You have received this letter because our records reflect that you may be a party interested in the assets of Fremont Indemnity Insurance Company.

The Superior Court of California, Los Angeles County, issued its order ("the Liquidation Order") appointing John Garamendi Insurance Commissioner, as Liquidator of Fremont Indemnity Insurance Company (the "Company in Liquidation") on July 2, 2003. The California Insurance Commissioner's Conservation & Liquidation Office ("CLO") has been assigned the responsibility of managing the liquidation of the Company in Liquidation on behalf of Commissioner Garamendi.

This letter is to inform you that our records indicate that you had one or more open claims at the time of the Liquidation Order. You do not need to file a "Proof of Claim" form for your open claim because the Commissioner has filed one for you. The above-referenced "Proof of Claim Number" is assigned to your claim so we can track it throughout the liquidation. Please refer to this number in all future communications you have with the CLO.

Please note that if you were a policyholder of the Company in Liquidation, you might receive other Proof of Claim forms in the mail for other claims that you might have against the Company in Liquidation. If you do, you must complete and return that Proof of Claim form to the CLO as described on the form and the information booklet that accompanies it. Proof of Claim forms will be mailed soon, or you may call the CLO at the telephone number above to request one. The deadline for returning Proof of Claim forms is June 30, 2004.

Although any person with a claim against the Company in Liquidation may file a Proof of Claim form, there are two cases in which the Commissioner files one on your behalf. (1) For Return(s)of Unearned Premium: Your policy was cancelled solely as a result of the Liquidation Order and you may be entitled to a return of a portion of the premium you previously paid. (2) For Open Claims At The Time Of Liquidation: You had an on-going insurance claim before July 2, 2003 but it was not settled or resolved by the Company in Liquidation before July 2, 2003. In all other cases the Commissioner will not file a Proof of Claim on your behalf. If you have any type of claim against the Company in Liquidation other than an open claim at liquidation or refund of unearned premium claim, you must file a Proof of Claim Form by June 30, 2004.

If you reside in a state in which Fremont Indemnity was licensed, your claim may be covered by the Insurance Guaranty Association ("IGA") of your state. IGAs often provide coverage for claims against insurance company policies once the insurance company goes into liquidation. For contact information for the IGA of your state, please visit the "Guaranty Fund Managers" section of the NCIGF website (www.ncigf.org). Most open claims will have already been transferred to the IGA of your state.
